
Terms & Conditions
All products are sold subject to the terms and conditions set out below. Certain words and phrases are defined in the definitions section and have special meaning.
Acceptance of Order
Your order becomes binding as soon as we have accepted it, subject to your rights of cancellation.
The standard or bespoke furniture products you order will be made specifically to your order, in accordance with the instructions and specifications you have given us. We reserve the right to insist on carrying out installation of kitchen projects where practicable under our local kitchen service.
It is your responsibility to check all details and aspects of your order are correct - particularly when we send you your order acknowledgement; and that the goods are suitable for your requirements, including measurements, dimensions, Product features, access and delivery.
Cancellation
Standard and bespoke furniture is made to your order and therefore ‘personalised’ as recognised by the Distance Selling Regulations. If you need to amend or cancel your order for standard or bespoke furniture, you have the right to do so at any time up to 48 hours after you have placed your order. If you amend your order in any way more than 48 hours after you placed it, we reserve the right to charge you any costs we have incurred in relation to your order.
Standard and Bespoke furniture products cannot be returned after you have received them unless they are confirmed as defective or damaged in which case they will be taken away by the delivery service and repaired or replaced at our discretion.
Access
It is your responsibility to ensure that the furniture you have ordered will fit into your home. It is very important that you carefully measure where the piece is going to go and ALSO whether we can get it to the location. If there are tight corners, narrow staircases and doorways, it may not be possible to deliver your order. You also need to check that there is sufficient access for our large delivery lorry to reach the delivery address. Please be sure to check these details in advance of placing your order.
Access for triple bookcases.
Triple bookcases arrive as a top and a bottom. Because of their size and weight it is not possible to carry them up flights of stairs or around tight corners. If access is a problem for any of our furniture we can make the item in more pieces call for a bespoke quote.
Dimensions
Please note item sizes are nominal and may vary +/- 2 cm on sizes stated. Where space or fit are of paramount importance the customer should satisfy themselves that the item is suitable for the purpose intended and will fit the available space. When there are critical dimensions such as restricted ceiling height etc. we must be given the measurement together with any desired clearance. When measuring your room remember to measure within skirtings at floor level and use metric measurement to the nearest millimetre. We cannot be held responsible for inaccurate measurements.
Colour
Please note that due to the limitations of the photographic and printing processes, goods may not appear the same colour as shown in the catalogue. If you would like hand painted swatches, you can request them by calling our sales line. Paint colours can vary from batch to batch and we cannot be held responsible for any perceived differences between shade cards and actual pieces of furniture. All furniture is hand painted with a non-toxic water based eggshell paint finish which is wipeable. We include a pot of touch-up paint in your customer care pack to take care of any minor marks.
Liability
Because our furniture is made specially to your order it is not possible to return it if not suitable. If furniture arrives damaged or we have made mistakes with your order we will of course repair or replace it as soon as possible (N.B. Touch-up paint for minor marks is included in every customer pack). Please check your furniture carefully and report any problems immediately on delivery as we will not be held liable for visible defects identified after receiving a signed acceptance of delivery. We cannot be held liable for conditions of use or storage within the customers’ house after delivery which may affect the furniture in any way; nor for the failure of customer’s tradesman to install furniture / plumbing / electrical work correctly to our recommended installation instructions which are included in the customer pack.
Prices
We reserve the right to change prices without notice.
Every effort is made to ensure that prices are correct at the time of publication including VAT. If an error has been made, we or you may cancel the order subject to the terms indicated under “Cancellation”.
Definitions in these Terms & Conditions
'Goods' means the goods on your order form or in your shopping basket at the time of ordering. It includes any service that comes with any goods.
'Cancellation Period' means the period of eight days from the date of receipt of goods ordered by Distance Communication during which you are entitled to cancel your purchase order; however, please note that all our furniture whether Standard or Bespoke (apart from Beech Kitchen Trolley) is made to order and therefore not returnable;
'Distance Selling' means purchases exclusively made via telephone, fax, mail order and/or the Jonathan Avery website;
'Standard Furniture' means Furniture Products made to your order at our standard size and specification such as wardrobes, chests of drawers, bedside tables, tables etc;
'Bespoke Furniture' means Furniture Products altered in any way from our standard size and specification or made to measurements provided by you;
'Product or Products' means Jonathan Avery good(s);
'we', 'us', 'our' means Jonathan Avery the Company;
'you', 'your' means one of our customers.
